ARG Creative ("we", "our", "us") operates mobile applications, desktop software, and the ARG Store platform. This Privacy Policy explains how we collect, use, and protect your information across all our apps and services.

1. Information We Collect

Information You Provide

• Account registration data (email, username) when creating an ARG Store account
• Payment information processed securely through Stripe (we never store card details)
• Content you create (reviews, ratings, app uploads)
• License keys entered for software activation

Information Collected Automatically

• Device information (device model, OS version, app version)
• Usage analytics (app opens, feature usage, crash reports) — applies to mobile apps only; see Section 2 for desktop-specific practices
• Advertising ID (in mobile apps that display ads, such as PerfSync for Android, VisNov, and JellyThought)

2. Per-App Data Practices

PerfSync (Android)

• Displays ads via Unity Ads and Start.io — these ad networks may collect advertising ID and device data for ad serving
• In-app purchases are processed through Google Play Billing (Play Store version) or Stripe (ARG Store version)
• Performance monitoring data (CPU, RAM, battery) is processed locally on your device and never transmitted to our servers

PerfSync Desktop

PerfSync Desktop is standalone desktop software for Windows. Its data practices differ from the Android version:

License Activation Data

When you activate a PerfSync Desktop Pro license, the following information is sent to our license server:

• License key — your unique PSYNC-XXXX-XXXX-XXXX activation key
• Device identifier — a locally generated unique ID for your machine (see "Device Identifier Generation" below)
• Device name — your computer's hostname (e.g., "Michael's Laptop")
• Platform — your operating system (e.g., "desktop-windows", "desktop-macos", "desktop-linux")
• App version — the version of PerfSync Desktop you are running

This data is transmitted over HTTPS to our license server to verify your license, enforce the 3-device activation limit, and issue a signed license token.

Device Identifier Generation

PerfSync Desktop generates a unique device identifier to distinguish your machine for licensing purposes. This identifier:

• Is generated locally on your device using a randomly generated unique identifier
• Is a 36-character unique identifier
• Is stored locally in your PerfSync data directory (~/.perfsync/)
• Is sent to our server only during license activation and periodic license validation
• Cannot be used to identify you personally — it identifies the machine, not the user

Cryptographic License Verification

Your license token is digitally signed using Ed25519 public-key cryptography. This means:

• Our server signs your license token with a private key that never leaves the server
• PerfSync Desktop verifies the token's authenticity using an embedded public key
• This process ensures your license cannot be tampered with or forged
• No personal data is included in the cryptographic signature — only license metadata (tier, activation date, device ID, maximum devices)

License Token Storage

Your signed license token is stored locally on your device at ~/.perfsync/license.dat. This file contains:

• Your license tier (Free or Pro)
• License key
• Activation timestamp
• Token issue timestamp
• Device identifier
• Device name (your computer's hostname)
• Maximum allowed devices
• App version compatibility marker
• A cryptographic signature

This file is not transmitted to any third party. It is used solely by PerfSync Desktop to verify your license status offline.

Periodic License Validation

PerfSync Desktop checks your license status with our server approximately every 7 days when an internet connection is available. This check transmits your device ID and license key to verify that your license has not been revoked. If the server is unreachable, PerfSync Desktop continues to operate using the locally stored license token (offline-first design).

Cross-Device Sync Data

When you use PerfSync's network sync feature to connect multiple devices on your local network, the following data is transmitted directly between your devices:

• Song metadata (titles, BPM, key signatures, durations)
• Setlist data (names, song order, notes)
• Playback state (current position, play/pause status, metronome BPM)
• Tap tempo BPM updates

This data is transmitted peer-to-peer over your local network only. It is not sent to our servers, not stored in the cloud, and not accessible to ARG Creative.

No Telemetry or Analytics

PerfSync Desktop does not collect any telemetry, usage analytics, crash reports, or behavioral data. We do not use any third-party analytics SDKs in the desktop application. The only network communication is license activation, periodic license validation (every ~7 days), and local network sync between your own devices.

No Advertising

PerfSync Desktop does not display advertisements and does not collect advertising identifiers.

Desktop Payment Processing

Desktop purchases are processed securely through Stripe. Stripe handles all payment card data and transaction processing. ARG Creative receives only your email address, transaction ID, and the generated license key. We never see or store your payment card details. See Stripe's Privacy Policy for details on how Stripe handles your payment data.

ARG Launcher

• Does not collect or transmit any personal data
• Notification access is used locally to display notifications within the launcher — notification content is never stored or transmitted
• Usage access is used locally to display recent apps — no data is sent externally
• All settings and preferences are stored locally on your device

JellyThought

• All AI inference and text-to-speech processing runs entirely on your device — no conversations, prompts, or responses are sent to any server
• Voice models are downloaded from GitHub and Hugging Face when you choose to install them — only the download request is made, no personal data is transmitted
• The AI language model is downloaded from Hugging Face — same as above, download only
• Smart Web Search (optional) queries DuckDuckGo when enabled — no personal data is included in search queries
• Image recognition, text detection, and translation all run locally on your device — no images leave your device
• Memory system stores data locally on your device only
• Displays ads via Unity Ads and Start.io — these ad networks may collect advertising ID and device data for ad serving
• Camera and microphone permissions are used locally for image recognition and voice input — no audio or video data is transmitted

VisNov (Visual Novel Maker)

• Displays ads via Google AdMob (banner, interstitial, and rewarded video ads)
• Projects and stories you create are stored locally on your device
• If you use the Asset Marketplace (when available), account and transaction data is processed through Stripe
• Exported/shared visual novels do not contain personal data

ARG Store (Platform)

• Collects account data (email, username) for authentication
• OAuth login via Google or Discord shares only your email and display name with us
• Download history and purchase records are stored to provide your app library
• Reviews and ratings you submit are publicly visible with your username
• For app developers using our platform: uploaded app metadata, descriptions, and APK/AAB files are stored on our servers

3. How We Use Your Information

• To provide and improve our apps and services
• To process purchases, activate licenses, and manage your account
• To verify license validity and enforce activation limits
• To display relevant advertisements (in mobile apps where applicable)
• To send important service updates (e.g., security notices, purchase confirmations)
• To detect and prevent fraud or abuse

4. Data Sharing

We do not sell your personal data. We share data only with:

• Unity Ads and Start.io — for ad serving in supported mobile apps
• Google Play Billing — for processing in-app purchases on Android (Play Store version)
• Stripe — for processing payments on ARG Store and PerfSync Desktop purchases
• Law enforcement — only when required by law

5. Data Storage and Security

Account data is stored on secured servers. Local app data (settings, projects, cached icons) is stored on your device. We use industry-standard encryption for data in transit (HTTPS/TLS).

PerfSync Desktop license data is stored locally at ~/.perfsync/ on your device. License tokens are cryptographically signed using Ed25519 to prevent tampering. Server-side license records (license key, email, device IDs, activation timestamps) are stored in an encrypted database on our secured servers.

6. Data Retention and Deletion

You can delete your ARG Store account at any time, which removes all associated data from our servers. Local app data can be cleared by uninstalling the app or clearing app data through your device settings.

PerfSync Desktop License Data

If you hold a PerfSync Desktop license and wish to have your data deleted:

• Local data: Uninstall PerfSync Desktop or delete the ~/.perfsync/ directory to remove all local license data, preferences, and databases from your machine.
• Server-side data: Contact us at [email protected] to request deletion of your license record, including your device identifiers, activation history, and associated email address. We will process deletion requests within 30 days.
• Deactivation: You may deactivate individual devices from your license at any time through the application or by contacting support. Deactivation removes the device's identifier from your license record on our server.
• Stripe records: Payment transaction records held by Stripe are subject to Stripe's data retention policy. Contact Stripe directly for deletion of payment records they hold.

7. Children's Privacy

Our apps and services are not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal data, please contact us and we will promptly delete it.

8. Your Rights

Depending on your jurisdiction, you may have the right to:

• Access, correct, or delete your personal data
• Opt out of targeted advertising (via your device's ad settings)
• Export your data
• Withdraw consent at any time
• Request a copy of the data we hold about you, including license activation records
• Request deletion of your license data and associated device identifiers from our servers

For EU/EEA residents (GDPR): Our lawful basis for processing license activation data is contractual necessity — we process this data to fulfill the software license you purchased. You have the right to data portability, the right to restrict processing, and the right to lodge a complaint with your local data protection authority.

9. Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be posted on this page with an updated revision date. Continued use of our apps after changes constitutes acceptance.

Terms of Service

These Terms of Service ("Terms") govern your use of all applications and services provided by ARG Creative ("we", "our", "us"), including but not limited to PerfSync, PerfSync Desktop, ARG Launcher, VisNov, ARG Store, and any future apps or services.

1. Acceptance of Terms

By downloading, installing, purchasing, or using any ARG Creative app or service, you agree to be bound by these Terms. If you do not agree, do not use our apps or services.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use our apps for personal use, subject to the terms described herein. You may not:

• Copy, modify, or distribute our apps or their source code
• Reverse engineer, decompile, or disassemble our apps
• Use our apps for any unlawful purpose
• Remove or alter any proprietary notices or labels
• Redistribute, sublicense, or resell our apps
• Share, publish, or transfer license keys to unauthorized parties
• Circumvent, disable, or tamper with any license verification or feature-gating mechanisms

3. Desktop Software Licensing

This section applies to PerfSync Desktop and any future ARG Creative desktop software sold under a license key model.

3.1 One-Time Perpetual License

PerfSync Desktop Pro is available as a one-time purchase. Upon completing payment, you receive a perpetual license key (format: PSYNC-XXXX-XXXX-XXXX) granting you access to all Pro features included in the version available at the time of purchase. This license does not expire and does not require a recurring subscription.

3.2 Device Activation Limit

Each license key may be activated on a maximum of three (3) devices at any time. This limit is shared across all platforms (desktop and mobile combined). For example, you may activate your license on two desktop computers and one Android device, or any other combination totaling three devices.

3.3 Activation Process

To activate Pro features, you must enter your license key in the app and connect to the internet for initial verification. During activation, the following information is transmitted to our license server:

• Your license key
• A unique device identifier generated locally on your device
• Your device name (e.g., "John's Desktop")
• The platform type (desktop or Android)
• The app version

Upon successful activation, a cryptographically signed license token is stored locally on your device. This token enables offline verification of your license status.

3.4 Offline Use

After initial activation, PerfSync Desktop Pro functions fully offline. Your license is verified locally using the stored license token without contacting our server. A background validation check occurs approximately every seven (7) days when an internet connection is available. This check is non-blocking — the app does not require internet access to function after activation.

3.5 Device Deactivation

You may deactivate a device at any time from the app's Settings screen. Deactivation frees up a device slot, allowing you to activate your license on a different device. You may also deactivate a device remotely by contacting [email protected].

3.6 Free Tier and Trial

PerfSync Desktop includes a free tier with core features available without purchase. New users also receive a fourteen (14) day trial of all Pro features. No email address or payment information is required to start the trial. At the end of the trial, the app reverts to the free tier unless a Pro license is activated.

4. Cross-Platform Licensing

4.1 Desktop Pro Unlocks Android Pro

A PerfSync Desktop Pro license key also unlocks Pro features in the PerfSync Android app. To redeem your desktop license on Android, enter your PSYNC license key in the Android app's settings. The same three (3) device limit applies across both platforms.

4.2 Shared Device Limit

Desktop and Android activations share the same device pool. If you have activated your license on three devices (in any combination of desktop and Android), you must deactivate one device before activating another.

4.3 Google Play Purchases

Pro features purchased through Google Play's in-app purchase system on Android are governed by Google Play's terms and do not generate a PSYNC license key. Google Play purchases apply to the Android app only and do not extend to PerfSync Desktop.

5. Purchases and Payments

5.1 Desktop Purchases

Desktop software purchases are processed securely through Stripe (stripe.com). Stripe handles all payment processing, tax calculation, and transaction records. ARG Creative does not store or process your credit card or payment details directly.

5.2 Android Purchases

In-app purchases on Android through Google Play are governed by Google Play's terms of service. Refunds for Google Play purchases must be requested through Google Play.

5.3 ARG Store Purchases

Purchases made through the ARG Store platform are processed by Stripe and are subject to Stripe's terms of service. ARG Creative does not store or process your credit card or payment details directly.

5.4 Pricing

All prices are displayed in USD unless otherwise indicated. We reserve the right to change pricing at any time. Price changes do not affect licenses already purchased.

5.5 Taxes

Applicable taxes (VAT, GST, sales tax) are calculated and collected by the payment processor based on your location, as required by law.

6. License Revocation

ARG Creative reserves the right to revoke a license key under the following circumstances:

• Fraud or chargeback: If a payment is reversed, disputed, or determined to be fraudulent, the associated license key will be revoked immediately.
• Terms violation: If you violate these Terms, including but not limited to redistributing license keys, tampering with license verification, or using the software for unlawful purposes.
• Refund: If a refund is issued for a desktop purchase (see Section 7), the associated license key is revoked upon refund processing.
• Abuse of device limit: Systematic sharing of a single license key beyond personal use (e.g., distributing a key to an organization or publishing it online).

Upon revocation, Pro features are disabled on all devices associated with the revoked license key. The app reverts to the free tier. You will be notified via the email address associated with your purchase.

7. Refund Policy

All refund requests must be submitted to [email protected] within 14 days of purchase. Requests are reviewed within 3 business days.

7.1 Approved Reasons

• Software does not work as described and support could not resolve the issue
• Technical incompatibility that prevents use after troubleshooting with support
• Accidental or duplicate purchase

7.2 Requests Not Eligible for Refund

• Change of mind after activating and using Pro features
• Failure to check system requirements or the free tier before purchasing
• Extensive use across multiple devices prior to the request

7.3 Refund Processing

On approval, a full refund is issued to the original payment method and the license key is revoked on all devices.

7.4 Android and ARG Store Purchases

Refunds for purchases made through Google Play must be requested through Google Play. Refunds for ARG Store purchases follow the same policy above.

7.5 Consumer Rights

Nothing in this refund policy limits your statutory consumer rights under applicable law, including rights under the EU Consumer Rights Directive or similar legislation in your jurisdiction.

8. ARG Store Platform

For Users

• You must be at least 13 years old to create an account
• You are responsible for maintaining the security of your account
• Reviews and ratings must be honest and not abusive
• Downloaded apps are for personal use only

App Distribution

ARG Store currently distributes only first-party applications developed by ARG Creative. All apps available on ARG Store are created, maintained, and published by us.

9. User Content

Content you create using our apps (e.g., setlists and songs in PerfSync, visual novels in VisNov, notes in ARG Launcher) belongs to you. However, by submitting content to our platforms (reviews, marketplace assets), you grant us a non-exclusive license to display and distribute that content as part of the service.

10. Intellectual Property

All ARG Creative apps, logos, designs, and content are the intellectual property of ARG Creative. Built-in assets provided in our apps (icons, backgrounds, sounds) are licensed for use within the app only and may not be extracted or used elsewhere.

11. Disclaimer of Warranties

Our apps and services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not warrant that our apps will be uninterrupted, error-free, or free of harmful components. Use our apps at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law, ARG Creative shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or device damage, arising from your use of our apps or services. Our total liability for any claim related to a desktop software purchase shall not exceed the amount you paid for that purchase.

13. Termination

We may suspend or terminate your access to our apps or services at any time, with or without cause, with or without notice. Upon termination, your license to use our apps is immediately revoked. For desktop software, termination under this section has the same effect as license revocation described in Section 6.

14. Changes to Terms

We may update these Terms from time to time. Continued use of our apps after changes constitutes acceptance of the revised Terms. We will make reasonable efforts to notify users of significant changes, including changes to licensing terms, refund policy, or payment processing.

15. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms shall be resolved through good-faith negotiation before pursuing formal legal proceedings.
